ADDENDUM TO OFFICIAL CONTEST RULES

Please note that, because the Rock N’ Vote event scheduled for Tuesday, May 12, 2015 will not be held, the winner selection process in the Contest has been slightly modified. A winner will still be selected, but the Contest Period will now end at 7:00 PM (CT) on May 14, 2015. Paragraphs 4 and 5 of the Official Rules are hereby replaced with the following new Paragraphs 4 and 5.

4) Selection of Finalists: Six to 10 semifinalists (the “Semifinalists”) will be selected by the RedEye Editorial team from among eligible nominations. The final number of Semifinalists will be subject to RedEye editorial discretion. Video files of the Semifinalists will be posted in a video gallery at redeyechicago.com/rock for public voting. You may cast your vote at redeyechicago.com/rock during the first public voting period. The first public voting period will run from 4:01 PM (CT) on April 22, 2015 to 5:00 PM (CT) on April 26, 2015.

5) Selection of Winner and Notification: The four Semifinalists who receive the most eligible votes will be named finalists (the “Finalists”) and will be announced on or about April 29, 2015. If there is a tie for the fourth position, voting will continue for successive one-hour periods until the tie is broken. Video files of the Semifinalists will be posted in a video gallery at redeyechicago.com/rock for public voting. You may cast your vote at redeyechicago.com/rock during the second public voting period. The second public voting period will run from 7:01 AM (CT) on May 13, 2015 to 7:00 PM (CT) on May 14, 2015. The winner will be the Finalist who receives the most eligible votes. If there is a tie for first, voting will continue for successive one-hour periods until the tie is broken. The winner will be announced on or about May 15, 2015. A winner will be disqualified and the next leading vote recipient from all remaining Finalists will be designated the winner if: (1) a potential winner does not fulfill the eligibility requirements; (2) a potential winner does not adhere to the Official Rules; or (3) if the potential winner cannot be contacted for any reason.”

In addition, the vote limit set forth in Paragraph 7 (1 vote, per voter, per day) will apply to both first and second public voting periods.

OFFICIAL CONTEST RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

The Semifinalist and Finalist rounds of “RedEye Rock N’ Vote Competition” (the “Contest”) start at 12:01 AM (CT) on Monday, March 2, 2015 and end at 11:00 PM (CT) on Tuesday, May 31, 2015 (“Contest Period”). The sponsor of this Contest is RedEye, which is located at 435 N. Michigan Avenue, Chicago, IL 60611 (“Sponsor”). The Contest shall be subject to these Official Rules, and by entering, all contestants agree to abide and be bound by the terms and conditions herein and the decisions of the Sponsor.

1) Eligibility: This Contest is open to legal U.S. residents residing in the Illinois counties of Cook, Lake, McHenry, Kane, DuPage or Will who are 18 years of age and older as of the first day of the Contest Period and who are in a band or music artists. You must be an amateur musician. For purposes of this Contest, an amateur is defined as an individual or band that earns less than 10 percent of its income from public music performance. Employees (and their immediate family members (defined as spouse, parents, siblings or children) or household members (whether or not related)) of Sponsor, House of Blues and of their parent companies, affiliates, subsidiaries, advertising agencies, prize providers, and/or public relations companies associated with this Contest (collectively, the “Contest Entities”), are not eligible to participate. A potential winner may be requested to provide proof that all eligibility requirements are met as well as proof of ownership of the email address associated with the winning entry. Void where prohibited and outside the above-listed counties. This Contest shall be governed and enforced pursuant to Illinois law, excluding choice of law provisions.

2) How to Enter: Send an audio or video recording of your song (the “Song”) to Matt Pais, RedEye movie and music critic, by mail at 435 North Michigan Avenue, Chicago, IL 60611 or by email at mpais@tribune.com. Each entry must include a short biography (no more than 50 words) of the performer. The biography will not be included in the judging. The Song must be original and may be in any genre. If you mail your song, you can put it on a CD, DVD or a jump drive. Please be aware that any media will not be returned. All entries must be received by no later than 11:59 pm CT on April 12, 2015. Limit one entry per performer.

3) Submitted Materials: By submitting an entry, entrant represents and warrants that the Song submitted: is the original creation of the entrant or entrant’s group, that Entrant has all rights necessary to submit; has not been copied in whole or in part from any other work; contains no defamatory, threatening, obscene, harassing or otherwise unlawful material; has never been previously published or submitted to any other competition; and does not violate or infringe any copyright, trademark, or other proprietary or privacy or publicity right of any person or entity. If an entrant breaches any of these representations and warranties, or any of the Contest Rules, he or she is solely responsible for injury caused by the breach. Violation of any of these representations and warranties will be cause for disqualification. Entrants agree to indemnify, defend and hold Sponsor harmless against any and all liabilities, losses, damages, claims, debts, investigations, fines, penalties, costs, expenses and settlements (including attorneys’ fees and costs of litigation, settlement, judgment, interest and penalties) arising out of or related to a breach of the foregoing representations and warranties. Finalists grant to Sponsor an irrevocable, world-wide, fully-paid, perpetual license to use the winning Song in any and all media, now known or hereafter devised, in any manner related to the Contest, Sponsor, including but not limited to advertising for Sponsor, without prior notice, approval or compensation. Winner otherwise retains all rights to the Song. Entries that do not comply with these Official Rules or that otherwise contain prohibited or inappropriate content as determined by the Sponsor, in its sole discretion, will be disqualified and will not be considered for a prize. The Sponsor makes the final determination as to which entries are eligible to take part in this Contest and may be considered for a prize. Certain entries may be featured from time to time on the Contest website during the Contest, in Sponsor’s sole discretion; being selected as a featured Song is unrelated to the judging criteria (as described below) and does not guarantee selection as a prize winner in the Contest.

4) Selection of Finalists: Ten to fifteen Semifinalists will be selected by the RedEye Editorial team from among eligible nominations. The final number of semifinalists will be subject to RedEye editorial discretion. Video files of the Semifinalists will be posted in a video gallery at redeyechicago.com/rock for public voting. You may cast your vote at redeyechicago.com/rock during the public voting period. The first public voting period will run from 12:01 AM (CT) on April 24, 2015 to 7:00 PM (CT) on April 28, 2015.

5) Selection of Winner and Notification: The four Semifinalists who receive the most eligible votes will be named finalists (the “Finalists”) and will then move on to the final round of the Contest. Finalists must appear and perform at the Rock N’ Vote event at Venue TBD on Tuesday, May 12, 2015 from 7:30 PM (CT) to 10:315 PM (CT) in order to remain eligible in the final round. The final round consists of two elements: a) Onsite Voting: The online portion of the second public voting period will run from 7:30 PM to 10:15 PM (CT) on May 12, 2015. Voters will have an opportunity to hear each Finalist perform. Voters must submit one vote electronically onsite via Offerpop. Each vote will count for one point toward the Finalist’s total audience score. Each Finalist’s total points received from the audience will have an applied weight of 60% toward the final weighted score. b) Judges’ Voting: A panel of judges will also vote on the Finalists’ performances on the night of the event on May 12, 2015. The judges will rank the four bands on the following categories: stage presence, originality, and viral potential. Each Finalist will be rewarded a possibility of 10 points per category for a total possible score of 30 points. Each band’s total points received from the judges will have an applied weight of 40% toward the final weighted score. The two selection methods will be weighed as follows: onsite voting-60%, and judges’ selections-40%. Once all the votes are tallied, the total weighted score (sum of Judge’s and Audience’s vote) for each Finalist will account for the final ranking. The Finalist with the highest weighted total from the sum of the judges and audience’s vote will be awarded the grand prize. Sponsor will announce the winner at the Rock N’ Vote event. A winner will be disqualified and the next leading vote recipient from all remaining Finalists will be designated the winner if: (1) a potential winner does not fulfill the eligibility requirements; (2) a potential winner does not adhere to the Official Rules; or (3) if the potential winner does not attend the Rock N’ Vote event.

6) Prize: The winner will have the opportunity to perform at the Taste of Chicago on Sunday, July 12, 2015. Winner is solely responsible for any applicable federal, state and local taxes in connection with winner’s prize. Prize substitutions are not allowed, and prize is not transferable. Only Sponsor may elect, at its discretion, to substitute a prize of greater or equal value due to lack of availability for any given reason. Prize is awarded “as is” with no warranty or guarantee. All expenses not specifically provided for herein are the responsibility of the prize winner. Properly claimed prize will be awarded, but in no event will Sponsor award more prizes than are provided for in these Official Rules.

7) Conditions Applicable to All Voting: Limit 1 vote, per voter, per day during phase one of voting (April 24, 2015 through April 28, 2015). Limit 1 vote, per voter during the final Rock N Vote event on May 12th, 2015. All voters must be located in the United States at the time they cast their vote. Proxy voting is not allowed. This includes but is not limited to creating multiple or dummy emails. No one may purchase votes. The use of automated or third party software or web site to vote is prohibited. Sponsor reserves the right to disqualify any votes cast in violation of the above restrictions. Sponsor is not responsible for votes that are lost, late, deleted, garbled, corrupted, misdelivered, or misdirected.

8) Other Conditions: The Contest judges will make all final decisions in any and all issues related to this Contest, and their decisions will be final and binding in all respects. Winner may be required to sign and return an Affidavit of Eligibility and Release, and, if so, it must be returned to Sponsor within one week of the date Sponsor sends it to winner. Failure to return such document will result in that winner being disqualified, and Sponsor may randomly draw another winner from among all remaining eligible entries.

By entering this Contest, each entrant agrees to release, waive and hold harmless the Contest Entities from any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorney’s fees) resulting from accessing the Contest website; submitting an entry or otherwise participating in any aspect of the Contest; the receipt, ownership or use of any prize awarded; preparing for, participating in or traveling to and/or from any prize-related activity, or; any printing, typographical or other error in these Official Rules or the announcement of offering of any prize. Neither the failure of Sponsor to insist upon or enforce strict performance of any provision of these Official Rules or the failure, delay or omission by Sponsor in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of Sponsor’s right to assert or rely upon any such provision or right in that or any other instance.

By accepting the prize, winner agrees, where legal, to allow Sponsor and its agents and licensees to use their name, voice, photograph, likeness and any information provided on the entry form, in any medium of communication, including advertising, promotional or other purposes, without additional compensation.

9) Internet/Fraud/Tampering: If for any reason this Contest is not capable of running as planned, or if this Contest or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Contest and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor’s sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Contest or any portion thereof. If the online portion of this Contest is cancelled during the first public voting period, the Sponsor will select Finalists based on eligible, non-suspect votes received prior to the time of the action or event warranting such cancellation and will re-open the Contest for selection of the winner. If such cancellation, termination, modification, or suspension occurs, notification will be posted at the Contest website. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE (INCLUDING THE ENTRY SITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST WILL RESULT IN DISQUALIFICATION. Sponsor reserves the right to prohibit any entrant or voter from participating in the Contest if, at its sole discretion, Sponsor finds such entrant or voter to be tampering with the entry process or the operation of the Contest, or if such entrant or voter shows a disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner the Sponsor determines to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant, voter or Sponsor; or (c) in any other disruptive manner. Sponsor assumes no liability for: (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Contest; or (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Contest.

10) Winner List: For an Official Winner List (available after Wednesday, May 14, 2015), send a request and a self-addressed, stamped envelope to RedEye Marketing, ATTN: Jessica Schuh 435 N. Michigan Ave, TT300, Chicago, IL 60611. All requests for Winner List must be received by Sunday, June 30, 2013.
